Freight RAILCAR Modernization Credit

Summary#

This bill creates a new federal tax credit called the freight railcar modernization credit. It lets eligible taxpayers claim a credit equal to 10% of their "freight railcar fleet modernization expenses." The credit covers the cost of newly built replacement railcars placed in service and capital expenditures to modernize existing freight railcars if those railcars meet set improvement standards. The credit is limited to 1,000 qualified freight railcars per taxpayer and ends three years after the law is enacted. The law also requires a report from the Treasury on credit use within three years.

What it means for you#

  • Railcar owners or companies that buy or modernize freight railcars may be able to claim a tax credit worth 10% of qualifying expenses.
  • To qualify, new replacement railcars must be built after enactment, ordered or placed in service within three years, and must replace two scrapped railcars that were removed from the AAR Umler System during the taxable year.
  • Modernized railcars must show a "significant improvement": at least an 8% increase in capacity or fuel efficiency, or meet certain performance standards (AAR Standard S-286 or Pipeline and Hazardous Materials final rule HM-251/HM-251C).
  • The facility that builds the railcars must meet a "qualified facility" test that excludes facilities owned or leased by entities ineligible under 49 U.S.C. 5323(u).
  • Special rules apply for sale-leaseback transactions and syndication; credits cannot be claimed if the same expense already produced another tax deduction or credit.

Expenses#

  • Credit rate: 10% of freight railcar fleet modernization expenses for the taxable year.
  • Per-taxpayer cap: no more than 1,000 qualified freight railcars may be counted in a taxable year.
  • Term: credit applies only to qualifying amounts paid or property placed in service within three years after enactment. The amendments apply to property placed in service and amounts paid or incurred after December 31, 2024.
  • Other rules: if a credit is claimed, the tax basis of the railcar must be reduced by the credit amount; double benefits are denied; certain entities (including those described under 49 U.S.C. 5323(u)) are ineligible.

Proponents' View#

The bill and its title state the goal is to encourage replacement or modernization of inefficient, outdated freight railcars by providing a tax credit. Supporters included multiple House sponsors who introduced the bill and framed it as a way to promote railcar replacement, improvements in capacity or fuel efficiency, and to incentivize construction in qualifying facilities.
