Modify Investment Credits for Nuclear Facilities

Summary#

This bill changes parts of the Internal Revenue Code about investment tax credits for certain nuclear power facilities. It allows an election to remove the "public utility property" limitation for a "qualified facility (as defined in section 48E(b)(3)(A)) which uses nuclear energy to produce electricity." It updates section 50(d)(2) and section 50(d)(2)(B) to include that qualified nuclear facility language. The bill also amends section 6418(g)(4) so the progress expenditures limitation does not apply to eligible credits determined for those qualified nuclear facilities. The changes apply to taxable years beginning after December 31, 2026. The bill was introduced in the House and referred to the Committee on Ways and Means.
