Stop Subsidizing Private Jets

Summary#

This bill would change the Internal Revenue Code to stop allowing tax deductions for many expenses tied to private fixed-wing aircraft. It adds a new subsection to Section 162 that says taxpayers cannot deduct amounts paid to purchase, maintain, operate, or depreciate most private planes. The rule includes specific exceptions for certain aircraft and for businesses that use aircraft in particular ways. The change would apply to amounts paid or incurred after December 31, 2025. The bill was introduced April 30, 2026, and referred to the House Committee on Ways and Means.

What it means for you#

  • If you own or use a private fixed-wing plane for personal travel or general business use, you would not be able to claim tax deductions for buying, operating, maintaining, or depreciating that plane for amounts paid after December 31, 2025.
  • If your aircraft is primarily used to carry property, or is modified and used mainly for agriculture, firefighting, or emergency medical work, the bill would still allow deductions for those expenses.
  • If you run a business that provides flight instruction, skydiving services, scheduled passenger transport sold to the public, or sightseeing flights sold to the public, deductions for aircraft expenses used in those businesses would still be allowed.

Expenses#

The bill disallows deductions for "disqualified private plane expenditures," which the text defines to include amounts paid or incurred to:

  • purchase a fixed-wing aircraft, and
  • maintain or operate a fixed-wing aircraft, and
  • any deduction for depreciation or amortization of such an aircraft. Exceptions apply for aircraft used primarily to transport property; aircraft modified and used mainly for agriculture, firefighting, or emergency medical purposes; and aircraft used in specified businesses (flight instruction, skydiving, scheduled public air transport, or sightseeing flights to the public).
